High Court judgement in the case of Elmes v Essex – cohabiting partners

This case was heard before the High Court on 18 January 2018. The outcome removes the requirement for a nomination form for cohabiting partners (who meet certain criteria) to be completed.

From April 2014, a nomination form for cohabiting partners has not been required. However, between April 2008 and March 2014 a survivor’s pension could only be paid to cohabiting partners (who meet certain criteria) if the deceased person had completed a nomination form.

If your cohabiting partner paid into the LGPS and died between April 2008 and March 2014, we may not have been able to pay a survivor’s pension to you under the legislation at the time.
